testpanel Terms and Conditions

testpanel is an online research panel used by well-known companies to gather opinions on products, advertising and concepts. For every survey you complete, you earn credits that can be redeemed for rewards.

For the sake of readability, the masculine form is used in these Terms and Conditions. It always refers to persons of all genders.

1. Eligibility requirements

1.1 Only natural persons aged 16 or over are eligible to participate in testpanel.

1.2 Participation is only possible after successful registration and confirmation of your email address.

1.3 Persons working in the fields of market research, marketing, advertising or the press are generally excluded from participation.

2. Registration and membership

2.1 By registering, the participant agrees to be invited to take part in surveys by testpanel.

2.2 Registration does not oblige you to take part in surveys. All participation is voluntary.

2.3 Membership of testpanel is free of charge and indefinite.

2.4 Participants may terminate their membership at any time without giving reasons by logging into their user account and using the "terminate membership" function under "profile details".

2.5 Due to technical processing times, survey invitations may still be sent for a short period after membership has been terminated.

3. User account and access

3.1 Following successful registration, the participant will be granted access to a personal user account.

3.2 The user account can be used to view and amend personal data, manage credits and redeem rewards.

3.3 The participant is obliged to keep the login details confidential and to protect them from access by third parties.

4. Participation in surveys

4.1 There is no entitlement to participate in specific surveys or a specific number of surveys.

4.2 Surveys are selected based on the participant’s profile data and the specific study requirements.

4.3 Only one participation per survey is permitted, even if multiple invitations are sent.

4.4 testpanel reserves the right to set a time limit on surveys or to close them early once the required number of participants has been reached.

5. Quality assurance and exclusion

5.1 testpanel places great importance on the quality of the data collected.

5.2 Participants may be excluded from individual surveys or permanently excluded from the panel if:

  • if you knowingly provide false information,
  • multiple accounts are created,
  • surveys are taken multiple times,
  • responses are submitted extremely quickly, are contradictory, obviously implausible or of poor quality,
  • technical tools such as bots, scripts, VPNs or similar methods are used.

5.3 In the event of exclusion for reasons attributable to the participant, there shall be no entitlement to compensation or reinstatement. In the event of permanent exclusion, any credits accumulated up to that point shall be forfeited. There shall be no entitlement to payout or restoration of the credits balance.

6. Remuneration and credits

6.1 Remuneration is paid exclusively for fully completed surveys.

6.2 The amount of remuneration depends on the length and complexity of the survey and is paid in the form of credits.

6.3 Credits are added to the user account and are valid for two years from the date of crediting.

6.4 Screening questionnaires conducted to determine eligibility for a target group are not remunerated.

6.5 Referring members

Participants can invite new members via a personal referral link. For each referred tester, 300 credits will be awarded, provided that the tester fully completes the Profile Questionnaire and successfully participates in at least one survey.

6.6 Reservation in the event of breaches

testpanel reserves the right not to award credits or to revoke credits already awarded in the event of breaches of these Terms and Conditions.

7. Rewards and payout

7.1 Credits can be redeemed once the relevant minimum credit balance has been reached.

7.2 Available rewards and payout options can be looked up in the rewards shop.

7.3 No payouts shall be made unless the minimum number of credits has been reached.

7.4 If a payout is not made due to incorrect information provided by the participant, there is no entitlement to a further payout.

7.5 Upon termination of membership, any credit balance below the minimum number of credits required for payout will lapse.

8. Multiple registrations

8.1 Only one registration per person is permitted.

8.2 Multiple registrations – including those using different email addresses – are not permitted.

8.3 testpanel reserves the right to delete multiple accounts and permanently exclude the participant from the panel. There is no entitlement to reinstatement.

9. Data protection

9.1 testpanel processes personal data exclusively for the purposes of market and opinion research.

9.2 The data is analysed anonymously. No personal data is disclosed to clients or third parties.

9.3 Clients receive only aggregated results (e.g. tables, statistics).

9.4 The data protection guidelines issued by the market research associations BVM, ADM and ESOMAR shall apply.

10. Cooperation with third parties

10.1 testpanel cooperates with other market research institutes and may transfer rights and obligations related to individual surveys to cooperation partners, provided this is not to the detriment of participants.

10.2 Participants may be invited to take part in surveys where the content and technical implementation are carried out wholly or partly by cooperation partners.

10.3 The cooperation partners may use the collected data exclusively for the purposes of market and opinion research.

10.4 Remuneration for participation in surveys is always processed through testpanel.

11. Liability and availability

11.1 testpanel does not guarantee the constant availability of the website, the user account or individual surveys.

11.2 Liability for technical malfunctions, data loss, or delays is excluded, unless such issues arise from intentional misconduct or gross negligence.

11.3 testpanel shall not be liable for damages arising from force majeure or the actions of third parties.

12. Changes to the service and the Terms and Conditions

12.1 testpanel reserves the right to change or discontinue the service, individual functions or these Terms and Conditions at any time.

12.2 Participants will be informed of any significant changes in an appropriate manner.

12.3 Continued use of the service shall constitute acceptance of the amended Terms and Conditions.

13. Governing law and jurisdiction

13.1 The law of the Federal Republic of Germany shall apply.

13.2 To the extent permitted by law, the place of jurisdiction shall be the registered office of Untiedt Research GmbH.

14. Severability clause

Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
